What is AI marketing compliance review?

Short answer

Software that uses AI to flag possible problems in marketing and communications before compliance approves them.

Definition

AI marketing compliance review tools read a draft (a blog post, social post, email or website page) and flag language that may raise issues: performance claims, guarantees, missing disclosures, testimonials, or words your firm has banned.

They speed up the first pass. A person in compliance still approves the final piece.

Why it matters for advisors

As advisors use AI to write more marketing, review volume goes up. A pre-check tool helps compliance keep pace and gives advisors feedback before submission.

The rules haven't changed: the SEC Marketing Rule and FINRA Rule 2210 apply whether a person or a tool wrote the piece, and a tool's "pass" doesn't make a piece compliant.

Ask vendors what rule set the tool checks against and how often it's updated. A tool trained on FINRA communications standards may not flag Marketing Rule issues like testimonials or hypothetical performance, and the other way around.

Example

An advisor runs an AI-drafted LinkedIn post through the firm's review tool, which flags "beat the market." The advisor rewrites it before submitting to the CCO.

Watch out for

Watch for false negatives. Test the tool on pieces your compliance team previously rejected and see what it catches.
